Y'all shouldn't have an issue renting it out, but definitely bring it to the attention of the broker/agent and if yous accept a friendly championship company that y'all know, run it past them. Title guys might even flag it if they are super thorough. Not in a bad way necessarily. The seller may take converted it without getting the zoning changed. If the city catches air current you may run into an issue.
Honestly the safest thing to do would be to handle things now before closing and then you lot're not stuck holding the pocketbook subsequently.
if you demand annihilation repair-wise, simply hitting me up. We have a couple cracking crews.
If you do shut earlier changing zoning I can aid you navigate.

Thank you for the response. It's weird because it is definitely a duplex and definitely built like a duplex the whole neighborhood is. All the water, gas and electric are split. I am buying information technology from my cousin he bought it eight years ago as is from a lady.
I am probably going to close and worry well-nigh the zoning later. Because I was thinking about converting the garage into a 3rd unit.

Ask the title company to run across if there is a zoning variance on file. If not, it may be an illegal duplex and information technology can be an expensive and fourth dimension consuming gear up if Licenses and Inspections tags you. Trust me I know very well! Good luck.

@Bradford Behrins...also, this could have been zoned as a duplex in the by, but because prior owners were not keeping their rental license current it reverted to single family. Your best bet would be to cheque archives in the metropolis of Philadelphia.

Very often the zoning doesn't match the utilise of the property. When buying a holding in Philadelphia the seller should provide you with the city certification. That paper will state electric current utilize of the property forth with all/any violations. In add-on yous want to see nearly recent rental license for 2-units or for an owner-occupied duplex license. The license must be within-in 2 concluding years, otherwise you may have to deal with the zoning. The license along with the city cert volition exist your unit count proof.
Cheers,
Yuriy

There are enough of multifamily homes in Philadelphia that arent legal. You dont need a variance/ correct zoning for multiple electric/ gas meters. I would await upwards your holding at https://atlas.phila.gov and see if they have an active variance for a duplex. If not just know at that place is a expert possibility itll have a lot of time/effort to hopefully appeal and become it zoned correctly. If you lot rent it incorrectly obviously there are city concerns, but also bug with insurance and if you have issues with tenants/evictions.

Agree with everyone who is saying either get the seller to effigy it out before settlement or concur coin in escrow post-closing until information technology is resolved. Dealing with the city to become the correct zoning can be expensive and fourth dimension consuming. The city tin can too enforce that you have to make certain improvements mainly around burn down prophylactic that volition be costly.

Information technology could be 'incorrect' merely there are plenty if folks who do what they want and convert a SFH into a MFH. There are instances for example where lets say a legal 2-unit was zoned R10 in 2012, and then an update to the zoning happened and the property is now RSA5 which is SFH only. If at that time yous did not seek a variance and years get past, information technology may be tough without jumping through hoops to get the city to give you a variance for a 2-unit of measurement.

@Dylan Buttenbusch it might exist a good idea to get the opinion from a zoning counsel. If information technology'southward non legally a duplex, I would negotiate a credit to the sale cost in the amount information technology would toll to obtain a variance if one is necessary. I obtained a variance later on a four calendar month process. Concluded upward costing me around 7k. In that location was too no guaranty the variance Would be canonical, which means y'all only purchased a unmarried family for the price of a duplex. Information technology's all fun and games until yous become tagged by LI. If you are willing to take the take chances without knowing for sure than go for information technology. Skilful luck.

I would put a contingency in the contract that information technology has to be a "non conforming duplex". The urban center will do that for you if you lot can testify information technology has been used equally a duplex in the past. With carve up meters for water and electrical that is all I had to show when I purchased mine. Approach the city and see what they say.
